Gong Xianghe, Liu Lianjun, Chen Daoying and Wan Qianhui were Invited to Attend the 2021 Annual Conference of the Constitutional Law Research Society of the Chinese Law Society

From October 23rd to October 24th, 2021, the Constitutional Law Research Conference of the Chinese Law Society was held at the Minghua International Conference Center in Shenzhen, Guangdong Province, jointly organized by the Constitutional Law Research Society of the Chinese Law Society, Shenzhen University Law School, and Shenzhen University Hong Kong and Macao Basic Law Research Center. The theme of the conference was The Communist Party of China and the Constitutional Road of Socialism with Chinese Characteristics. The conference was attended by more than 200 delegates from the national constitutional law community. Professor Gong Xianghe, Professor Liu Lianjun, Associate Professor Chen Daoying and Teacher Wan Qianhui were invited to attend the conference.

 

 On October 23rd, three parallel sessions were held, respectively, from Xi Jinping's Important Discourse on Governing the Country and Government in Accordance with the Constitution, Constitutional Implementation and Implementation of the 14th Five-Year Plan, Constitutional Response to New Technological Development, Constitutional Review System with Chinese Characteristics, Organization and Procedures of the People's Congress System, The Constitution and the Construction Plan of China under the Rule of Law, The Constitution and the National Security Legal System, Improving the System of 'One Country, Two Systems' and the Construction of the Greater Bay Area, and the lively academic exchanges were held.

 

In the morning of the 23rd, Associate Professor Chen Daoying delivered a report on The Construction of Prior Review Mechanism in China's Constitutional Review in the sub-forum on Constitutional Review System with Chinese Characteristics. Associate Professor Chen Daoying pointed out that prior review is the main way to ensure the constitutionality of major decisions in China's constitutionality review system, and should be based on the construction of classification, clarify the power allocation mechanism of two-track unified system, give full play to the role of the local NPC Standing Committee and the General Office of the CPC Central Committee, and let the NPC Standing Committee hold the final review The NPC Standing Committee has the final review power. At the same time, the procedural mechanisms of the three different types of prior review, namely, consultation, legislative review and approval review, should be improved in a focused manner.

 

In the afternoon of the 23rd, Prof. Gong Xianghe delivered a report on Constitutional Moment: Constitutional Protection of Digital Human Rights in the sub-forum of Constitutional Response to New Technological Development. Professor Gong pointed out that with the advent of the digital age, the digital nature of people's social interactions has gradually emerged, and the protection and study of human rights have emerged as a crisis that requires constitutional response. Digital human rights have a solid human origin and a necessary constitutional foundation, and are gradually being transformed into constitutional and legal rights in many countries around the world. The development of China's constitution should face up to digital civilization and adopt various paths to promote the realization of digital human rights in response to the different stages of digital technology development.

 

In the afternoon of the 23rd, Prof. Liu Lianjun commented on the topic of The Organization and Procedures of the People's Congress System, and discussed the topic reports of the sub-forum, focusing on the boundary of the budgetary supervision power of the NPC, the method of the Bureau, the generation of the national institutional system and the specific rule of law practice of the NPC system.
