In the afternoon of April 8, 2022, sponsored by the Chinese Society of Criminal Law, Zhejiang University Procuratorate Basic Theory Research Center, Hangzhou Yuhang District People's Procuratorate hosted the second phase of the Chinese Society of Criminal Law Practical Criminal Law Forum crimes against personal information of citizens judicial practice issues More than 50 experts from the Supreme People's Court, Supreme People's Procuratorate, Peking University, Tsinghua University, Southeast University, Zhejiang University, Ali, Netease and other theoretical and practical aspects participated in this forum. Our Professor Ouyang Benqi was invited to attend the forum and acted as a talker.

Prof. Ouyang Benqi was invited to be the panelist in the third unit of the forum, Controversy on the Attributes of Legal Interests of Crimes Involving Infringement of Citizens' Personal Information, and gave an in-depth explanation on the protection of legal interests of crimes involving infringement of citizens' personal information. Prof. Ouyang Benqi conducted a comprehensive investigation on the protection of legal interests of the crime of infringing citizens' personal information from three levels: criticism of the private law legal interest view of the crime of infringing citizens' personal information, promotion of the public law legal interest view of the crime of infringing citizens' personal information, and reinterpretation of the crime of infringing citizens' personal information under the public law legal interest view, and analyzed the three cases discussed in the unit. Professor Ouyang Benqi pointed out that the legal interest protected by the crime of infringement of citizens' personal information is not the private legal interest of individuals or the supra-personal legal interest, but the right to protection of personal information under public law. The personal information protected by this crime should be delineated in the field; the effect of the consent of the information subject should be determined in a relative manner.

This practical criminal law forum focused on the crime of infringing citizens' personal information, and conducted an in-depth investigation on five major issues: the concept and scope of citizens' personal information in criminal law, the distinction and definition of information types in the crime of infringing citizens' personal information, the controversy over the attributes of legal interests in the crime of infringing citizens' personal information, the determination of the crime of infringing citizens' personal information and the value consideration, and the multiple governance of personal information protection. The seminar provided new ideas and perspectives for the theoretical study and judicial determination of the crime of infringing personal information of citizens. Professor Ouyang Benqi's speech was well received by the moderator and the audience. Professor Ouyang Benqi pointed out that Southeast University Law School has maintained good cooperation and deep academic friendship with the Chinese Society of Criminal Law and the Supreme People's Court, and will continue to collaborate with them in the future to explore the positive interaction between legal theory and judicial practice. The forum demonstrated the scientific research standard of our school in the field of social science research, fully demonstrated the profound academic quality and solid scientific research strength of our teachers, and enhanced the academic influence of our school in the country.
