On the evening of 28th October, Professor Jiang Hongzhen, Doctoral Supervisor of Shanghai Jiao Tong University Kai Yuan Law School, Deputy Editor-in-Chief of Journal of Shanghai Jiao Tong University (Philosophy and Society Edition), and Executive Director of the Compliance Research Centre, gave a brilliant academic lecture on the topic of ‘Administrative Law Issues in the Digital Era’ to the teachers and students of our college.
The lecture was hosted by Professor Yang Dengfeng of the Department of Constitutional and Administrative Law, who warmly welcomed Professor Jiang Hongzhen and briefly introduced Professor Jiang's outstanding achievements and contributions in the field of law.
Starting from the legal issues in the digital era, Prof Jiang Hongzhen compared the connotation and extension of four groups of concepts (network and information jurisprudence, computational jurisprudence, data jurisprudence, and digital jurisprudence) that have been frequently mentioned by the jurisprudence community in the digital era, and gave a macroscopic description of the relevant norms involved in the current research on digital administrative law by means of policy combing. Then, with the title of ‘Administrative Law Issues in the Digital Era - Observations from the “Relief End”’, Professor Jiang analysed four cases, including the Xiyou Company case, the Yang Regime case, the Chen Chao case and the Zeng Haibo case, from a micro perspective. and Zeng Haibo case, showing in detail the problems brought by the digital era to the implementation and enforcement of administrative law, and how the law should respond to them.
In the talk session, Prof Yu Lixhen and Prof Liu Qichuan shared their views. Professor Yu Lixin highly praised Professor Jiang Hongzhen's lecture, believing that Professor Jiang retraced the administrative procedure law system from the perspective of the ‘relief side’, and through the detailed interpretation of four specific cases, he realised the revelation of the change of the administrative law in the era of intelligence, and to a certain extent, he realised the dispelling of the phantom of the intelligent technology. Professor Liu Qichuan pointed out that Professor Jiang Hongzhen's lecture has important theoretical significance and practical value, which focuses on the integration of mathematics and intelligence in the process of administrative law enforcement, and is both practice-oriented and has comprehensive innovative value. At the same time, Prof Liu Qichuan also put forward his views on the challenges brought by the digital era to the principle of administrative due process and the possible problems of the Yang regime case.
During the interactive stage at the end of the lecture, our teachers and students actively asked questions, and Professor Jiang Hongzhen provided professional and detailed answers to each question.
In this two-hour lecture, Professor Jiang Hongzhen, through her in-depth and highly condensed expression, used the cited and incisive theoretical knowledge and analytical perspectives to inspire the teachers and students in the meeting and make their thoughts soar, and stimulated their interest in the direction of the development of administrative law in the digital era, and deepened their understanding of how the administrative law should be transformed in order to respond to the challenges of the digital era, which made the activity a complete success.
