On the afternoon of October 29th, Beijing University of Aeronautics and Astronautics law professor, doctoral tutor, deputy editor of the ‘record review research’, director of the Beihang record review system research centre Wang kai to ‘the essence of the fundamental rights of the connotation of the protection’ as the title, for our teachers and students to bring a brilliant academic lectures.
The lecture was hosted by Professor Gong Xianghe, Executive Director of Human Rights Research Institute of Southeast University, Department of Constitutional and Administrative Law, School of Law, Professor Gong Xianghe expressed a warm welcome to Professor Wang Kai's arrival, and briefly introduced Professor Wang in the field of law and outstanding achievements and contributions. Professor Wang started from the hot controversy of ‘whether life imprisonment constitutes an excessive restriction of citizens’ fundamental rights’, introduced the provisions of the German Basic Law on the essence of fundamental rights, and introduced the definition of the essence of fundamental rights in detail. Immediately after that, Professor Wang pointed out that the way to guarantee the essence of fundamental rights is ‘not to be touched’, and analysed in detail how to judge whether the essence of fundamental rights has been touched or not, and the way and method to do so. He analysed the relationship between the guarantee of the essence and the principle of proportionality, and put forward a proposal to improve the constitutionality of life imprisonment in light of the existing norms and practices in China.
In the talk session, Professor Liu Lianjun, Professor Xiong Zhanglin and Associate Professor Chen Daoying shared their views. Professor Liu Lianjun highly praised Professor Wang's lecture, which is important for the introduction of the German theory of the protection of fundamental rights within the nature of fundamental rights, and provides new ideas and perspectives for the legal community in the study of the protection of fundamental rights. At the same time, he suggested that the special significance of life imprisonment in China should not be ignored, and therefore, it is necessary to further reflect on how to maintain a balance of interests in the ‘care’ of fundamental rights protection for this group of people. Professor Xiong Zhanglin continued to ask Professor Wang, from an administrative law perspective, which situations could not be resolved by the principle of proportionality and had to be determined by introducing the theory of guarantee of the essential content of fundamental rights. Associate Professor Chen Daoying added some background knowledge about the German theory of fundamental rights protection, and she highly agreed that the introduction of this theory is of great value to the development of the theory and practice of fundamental rights protection.
In the interactive stage at the end of the lecture, our teachers and students actively asked questions, and Professor Wang Kai provided professional and detailed answers to each question.
