On the afternoon of 19 February 2025, the 19th Digital Law Youth Academic Salon of Future Rule of Law and Digital Intelligence Technology Innovation Laboratory of Southeast University was successfully held in Room 510 of the Law School. This salon was hosted by Associate Professor Yang Jie, and Associate Professor Xu Minchuan, Associate Professor Ren Danli, Associate Professor Wang Yuan, Teacher Bi Wenxuan, Teacher He Yingxin, Teacher Bi Sheng, and doctoral and master's degree students from the Digital Law Team of the School of Law participated in this activity.
Shi Yunxin, a master's student of grade 24, made a special report on the topic of ‘On the Criminalisation Standard of Data Crawling in the Age of Digital Economy - Taking the Evolutionary Progress of US Case Law as a Perspective’. The report discusses the legal regulation of data crawling in the era of digital economy, and introduces the transformation of US case law from contract theory and agency theory to code theory, as well as the evolution of the incrimination standard from subjective authorisation standard to objective standard. On this basis, the report puts forward a binary view of data security legal benefits, advocating taking into account the value of static security and dynamic circulation of data, and providing ideas for balancing China's criminal law regulatory system of data security and utilisation.
In the exchange session, reviewer Sun Yu, a PhD student of grade 22, suggested the structure and content of the article in terms of focusing on the characteristics of the digital economy, unifying the definition of data crawling, clarifying the research problem, and basing on China's practice. Teacher He Yingxin of the School of Law commented on the article's research problems, sectoral and comparative research methods, conceptual accuracy and case accuracy from both macro and micro levels. The rest of the students and teachers expressed their opinions and discussed the technical principles of data crawling, the path of regulation of different sectoral laws, the selection of comparative law and other issues, and made valuable suggestions for the revision of the article.
He Luping, a 23rd grade master's student, wrote a paper titled ‘The Normative Interpretation and System Construction of Trademark Law on the Protection of Trademark Pre-use Right’, focusing on the protection of the pre-use right of unregistered trademarks, pointing out the conflict between the system of trademark use acquisition and the system of registration acquisition, applying Hohfeld's right theory to analyse the right form of the pre-use right of trademarks in a detailed way, and combining the influence level and the virtual and real scenarios to put forward the graded protection scheme, in order to balance the relationship between intellectual property rights and free competition. In the evaluation session, Shen Liaojia, a 23rd grade master's degree student, took the argumentation of Hofeld's right theory as the core, combined with the hypothetical case, and put forward the argumentation suggestions from the basis of the division of the right form, the possible conflict of the right protection, and the comparison of the legal systems, and other perspectives. Mr Bi Wenxuan of the Law School affirmed the novelty of the topic and the professionalism of the academic expression, but suggested modifying the title to correspond to the content of the article; explained in detail the differences in the intensity of protection between registered and unregistered trademarks, and the advantages and disadvantages of the registration system and the use system in the protection of trademarks; and finally put forward a proposal for constructing a protection path. The rest of the students and faculty members engaged in heated discussions on thesis writing standards, argumentation methods and revision techniques. The salon was successfully concluded in a warm academic discussion.
